Proposition 8 Ruled Unconstitutional

    The California verdict is out. The three justices decided that Proposition 8 violates the constitution.

    The decision pointed out that:

    Now it goes to the Supreme Court.

    Prop 8. Overturning of gay marriage ban hailed as historic.

    If the Supreme Court agrees I wonder how the states would react to that?

    I just can't understand why this makes such a difference to so many people. If it makes the gay folks happy, why not? If this threatens the institution of marriage, this calls the institution into question.

    I agree with overturning the ban. I can't believe so many, narrow-minded, idiotic, liberal, anti-homosexual Californians passed it in the first place.

    Right! It's liberals that are always trying to curtail gay rights in this country. And it was probably a group of liberals that sponsored Prop 8 in the first place, oh wait, the ProtectMarriage.com organization sponsored the initiative that placed Proposition 8 on the ballot. You seem conflicted at best.

    I guess when it is all said and done gays and lesbians will become one of the constitutionally protected groups. It will not be long afterwards that Title IX will force colleges to implement gay sports. Can't wait to watch gay college football on ESPNG.

    Overturning a ban on something really isn't the same as being constitutionally protected. No law that discriminates against someone for their sexual orientation will be protected by the Constitution. That hardly constitutes gays being a constitutionally protected group. They simply have the same protections that the rest of us already have.
    It would be like a group getting together and passing a law that discriminates against farmers because they have dirt under their fingernails. If that law were overturned, farmers wouldn’t have special constitutional protections, they would have the same protections that the rest of us have.

    The people of California voted on this issue. How can a court of a few people overturn the will of millions of Californians?

    How? Are you really asking how? Do you remember that thing called the Constitution? That is how. The Constitution provides the framework that prevents the majority from running rough shot over a minority. This can go against popular opinion but it is still the Constitution and we have to follow it. Unless you have something against the Constitution of this great land? Cus them is fightin' words. Why do you h-a-a-a-a-a-a-a-t-e the Constitution?

    Yeah, I know where judicial powers are addressed in the Constitution, I just didn't see where it stated 3 judges could attempt to overturn the will of the people on a social issue.

    I didn't say that gays were a constitutionally protected group, just saying that is the direction this issue is headed. I don't see how the issue can be settled any other way. Seems to me striking down Prop 8 has to cut both ways. If legislation exclusively protecting heterosexuals is unconstitutional - what about the legislation that exclusively protects gays?
